Ownership of rights
All rights, including copyright, in this website are owned by or licensed to 'Goodwill Network'. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.
Accuracy of content
We have taken every care in the preperation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods and services have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or services and their prices as advertised on this website. If the prices of the goods or services increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by email that the new prices are acceptable, unless otherwise advised through discretion of the director, through an honoured 'goodwill guesture'. If it is not acceptable, then you will of course have the right to cancel your order. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.
Damage to your computer
We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any website accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
All items are subject to availability. We will inform you as soon as possible if the goods or services you have ordered are not available. The Goodwill Network is a UK based company, operating within England. All orders outside of this region will be processed and accepted on approval from the director. We reserve all rights to refuse this order, and do not accept liability to anybody for this decision.
You are able to correct errors on your order up to the point of which a deposit is made for the initiation of your order. If we develop your order or part of your order as agreed with you and you subsequently change your mind about what you need, the work done will still have to be paid for. This makes it important that you carefully specify your order before work commences. Be sure to plan your requirements and know what you want. We can help you with this on request.
We will charge your account upon acceptance of the order, unless delivery cannot be fulfilled within 30 days. We accept no liability if a delivery of goods or service is delayed because you did not provide the correct payment details. All service orders, require a non-refundable up front payment, with any balances due payable on completion of the order. If it is not possible to obtain full payment for any goods or service's then we can cancel the contract and or suspend any further delivery of goods or services to you. This does not affect any other rights you may have. If full payment is not paid by the due date, we reserve the right to accrue interest both before and after judgement on the unpaid portion of the price at the rate of four per cent.
Delivery charges vary according to the type of goods ordered, and cannot be refunded.
We cannot accept any liability for any loss or damage to the goods or service once they have been delivered in accordance with your delivery instructions. We will aim to deliver by the date quoted for delivery, but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.
Risk and Ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
Acknowledgement and acceptance of your order
All agreed prices are valid for a seven day period, and become invalid after this time if deposit is not made. You will need to provide us with your email address and we will notify you by email as soon as possible to confirm receipt of your order and confirm details. An acceptance of your order will take place when we have received the required deposit, and a confirmation receipt is sent.
Under the distance selling regulations, you have the legal right to cancel your order within seven days in writing, of order acceptance, and receive a full refund of your deposit. If this period is expired and the customer wants to cancel, (which must be done in writing), the customers deposit will be used to cover losses and costs the Goodwill Network suffers because of the cancellation. If the Goodwill Network Cancels the contract, we will pay the balance of any payments made, after costs incurred for third party services and a twenty five per cent admin fee is deducted.
Graphic design will be carried out, after we discuss with the customer what they are looking for. A maximum of three drafts will be constructed, which are chargeable. All designs require full advanced payment before any work commences.
Customer website content
All sites are constructed within the timescale specified for project completion. If this is delayed by yourselves due to content not being delivered, we will not be held liable for any delays, or costs incurred due to delays. You should always try to provide your site material in electronic format. The actual format is not particularly important as long as it is saved in a file. Even basic emailed text is fine.
Managed hosting, is a service offered and managed by the 'Goodwill Network' and the servers are maintained by third party services. In the event of temporary service loss, data loss, or any other technical fault resulting from our third party actions, we will not be held liable for any third party issues out of our control, but will do our best to have the problem resolved as soon as possible. We will not be liable for any service loss, due to non renewal of hosting services by the customer through neglect of notification renew notices, or any automated service errors.
All domains which are purchased in conjunction with a managed hosting service will be registered under the 'Goodwill Network'. We will managed these domains for you, but full ownership remains the customers, who will be responsible for all renewals. We ensure that an automated renewal notice is sent out to the customer to help prevent any loss of service. We will not be held liable for any loss of service due to customer neglect of notification, or any automated service errors. Although we aim to keep an accurate record of all domain registration and renewals, the customer should keep proof of there purchase, in the case of any data loss on our systems.
One Stop Web Service
The ‘ONE STOP Web’ service will require a £99 one off design/setup fee, which is paid in advanced with the first
monthly billing. Design takes from 3 to 30days depending on your specification. Any requested dynamic or bespoke
additions, may affect the designing period. It is important that your web material is provided within this time frame in
a digital format, as we reserve the right to begin the billing after 30 days of order acceptance. If your design is
delayed by ourselves we will credit your account accordingly. Acceptance of the order will form your monthly billing
date, of which payment will be required, on the same day each month (example Order acceptance date: 1st January –
renewal payment date on or before 1st February). Standing order details will be available for you to setup with your
bank and our account details can be found on the bottom of our invoices. The Goodwill Network will not be held
liable for any resulting actions from reminders not being sent due to circumstances beyond our control. Responsibility
of remembering to pay on time remains the customers. Late payment may deactivate your account, so please
ensure you pay by the due date, to avoid incurring a re-activation fee. The Goodwill Network reserves
the right to decline the acceptance of this order, due to any reason it sees fit. The Customer has the right to cancel
the ‘One Stop Web’ Service at any time, of which the remaining balance after costs incurred to the Goodwill Network,
will be refunded. We will not tolerate any material on any One-Stop website, which the Goodwill Network deems as unacceptable, and reserve the right to terminate the account with immediate effect, if rectifications are not made within 24hrs of said violations
All One Stop services are in conjunction with our standard terms and conditions listed here on our website. This does not subtract liability of terms agreed on approval of the order.
Exclusion of liability
Any disclaimers and exclusions of liability in these terms and conditions shall not apply to any damages arising from death or personal injury caused by negligence. These disclaimers and exclusions shall be governed by and constructed in accordance with English law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Changes to legal notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
Law, jurisdiction and language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
The 'Goodwill Network' are committed to protecting the privacy of anyone using our site and the confidentiality of any information that you provide us with. The purpose of this statement is to set out how we use any personal information that we may obtain from you.
Data Protection Act 1988
We are registered under the Data Protection Act and comply with the Act in all our dealings with your personal data.
Use and collection of personal information
In general you can visit our website without telling us who you are and without revealing and information about yourself. If, however, you use our site you will need to register and will be asked to provide certain information such as contact details. We will store this data and hold it on computer or otherwise.
We may use information that you provide:
(a) To Register you with our website and to administer it.
(b) For assessment and analysis, eg. marketing, customer and product review and product analysis, to enable us to review, develop and improve our services.
(c) We do not sell, trade or rent access to your personal information to others
We endeavour to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data that you disclose online and we will not be responsible for any breach of security unlelss this is due to our negligence or wilful default.
